1. Acceptance

By downloading, installing, or using Gainly ("the app"), you agree to these Terms and Conditions in full. If you do not agree, do not use the app.

2. What Gainly Does

Gainly is a fitness progress tracking app that lets you:

• Log workout sessions, sets, reps, and RPE-based effort ratings
• Schedule workouts across the week and follow a training plan
• Track body measurements, nutrition, hydration, and daily wellbeing
• Photograph your physique and receive AI-powered analysis scored across Symmetry, Proportions, Conditioning, and Development (Gainly Pro subscribers)
• View progress over time through charts, trends, streaks, and personal records
• Optionally read readiness and cycle data from, and write workout/body data to, Apple Health

3. Eligibility

You must be 18 years of age or older to use Gainly. By using the app you confirm that you meet this requirement. The AI physique analysis feature is designed exclusively for adult users; our AI model is instructed to decline analysis if it judges the subject of a photo to be a minor. This is a content-level check performed by the AI, not a substitute for your own confirmation of eligibility.

4. Subscription and Billing

4.1 Free Tier

Free users receive 3 lifetime AI physique analyses (this allowance can increase through referral rewards) and full access to workout logging, nutrition tracking, and progress charts within the following limits: 30-day history, 200 progress photos, 3 albums, 7 workout sessions per week, 3 saved body measurements, and 2 training plans. Usage limits are subject to change with advance notice.

4.2 Pro Lite Subscription

Pro Lite unlocks the following non-AI features on a recurring subscription basis:

• Full history beyond the 30-day free window
• Unlimited progress photos, albums, and body measurements
• Advanced body measurement charts and progress indices
• Year in Review
• Photo overlay history
• Export training and measurement history to CSV
• Journey insights and time capsule (day-one vs. today comparison)

Pro Lite does not include AI-powered physique analysis. That requires a Gainly Pro subscription. Additional features may be added to either tier over time without a price change; we do not promise features beyond those listed here or currently shown in the app's paywall.

• Price: $2.99 / month or $24.99 / year (sale prices may apply).
• Billing: Charged through your Apple ID on a recurring monthly or annual basis.
• Cancellation: Cancel any time in iOS Settings → Apple ID → Subscriptions → Gainly. Access continues until the end of the current period.

4.3 Gainly Pro Subscription

Gainly Pro includes everything in Pro Lite, plus:

• 5 AI physique analyses per week (resetting weekly)

• Trial: No free trial is currently offered on Gainly Pro. Any trial or introductory offer, if introduced in the future, will be disclosed at the point of purchase through Apple's standard purchase confirmation.
• Price: $14.99 / month or $79.99 / year (sale prices may apply).
• Billing: Charged through your Apple ID on a recurring monthly or annual basis.
• Cancellation: Cancel any time in iOS Settings → Apple ID → Subscriptions → Gainly. Access continues until the end of the current period. No partial refunds are issued.
• Price changes: You will be notified through the App Store in advance of any price change.

All billing is managed by Apple. We do not process payments or store payment information.

4.4 Refunds

Refund requests must be submitted to Apple at reportaproblem.apple.com. We do not issue refunds independently of Apple's standard refund policy.

5. Acceptable Use

You agree to use Gainly only for its intended purpose of personal fitness tracking. You must not:

• Submit photos of minors for AI analysis
• Use the app for any unlawful purpose
• Attempt to reverse-engineer, decompile, or tamper with the app or its backend
• Circumvent usage limits, subscription gates, or other access controls
• Submit photos or content that violates applicable laws or third-party rights
• Use the app in any way that could harm yourself or others

6. Health and Fitness Disclaimer

Gainly is not a medical application. AI analysis scores, workout progression suggestions, and nutrition guidance are for informational and motivational purposes only. They do not constitute medical advice, diagnosis, or treatment.

• Do not rely on Gainly as a substitute for a qualified healthcare or fitness professional.
• Consult a doctor before beginning a new fitness program, particularly if you have any existing health conditions.
• RPE-based weight suggestions and AI physique scores are algorithmic estimates — they may not reflect your actual health or fitness status.
• We expressly disclaim any liability for health or training decisions made based on information provided by the app.

7. Intellectual Property

All content within Gainly — including the app design, workout templates, AI prompts, software code, and graphics — is owned by Turlybek Dostan Turagazyuly and protected by applicable intellectual property laws.

You retain full ownership of the photos and personal data you enter. By submitting a photo for AI analysis, you grant us a limited, temporary licence to transmit that photo to our AI processing pipeline solely for the purpose of generating your analysis result. This licence expires immediately once the result is returned.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• Gainly is provided "as is" without warranties of any kind, express or implied.
• We do not guarantee the app will be error-free, uninterrupted, or always available.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the app.
• Our total liability for any claim shall not exceed the amount you paid for the app in the 12 months preceding the claim.

9. Service Availability

We reserve the right to modify, suspend, or discontinue the app or any of its features at any time with or without notice. AI analysis availability depends on third-party services (Anthropic, Firebase) and may be subject to outages outside our control. We are not liable for any interruption to these services.

10. Third-Party Services

Gainly integrates with the following third-party services, each governed by their own terms:

• Apple App Store — app distribution and payment processing
• Apple iCloud — data synchronisation across your devices
• Apple Health — readiness/cycle data reads (opt-in, all users) and workout/body data writes (opt-in, Gainly Pro)
• Apple App Attest — device integrity verification
• Anthropic Claude API — AI-powered physique analysis
• Google Firebase (Cloud Functions, Firestore, App Check) — secure analysis proxy and usage-limit enforcement

We are not responsible for the practices or availability of these third-party services.

11. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be communicated through an in-app notice or by updating the date above. Continued use of the app after changes are posted constitutes your acceptance.

12. Governing Law

These Terms are governed by the laws of the Republic of Kazakhstan. Any disputes will be resolved through good-faith negotiation between the parties.
