1. Acceptance of Terms

By downloading, installing, or using Gainly ("the app"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the app.

2. Description of Service

Gainly is a fitness progress tracking application that allows users to:

• Photograph and document their physical progress over time
• Receive AI-powered analysis of their physique based on submitted photos
• Track body measurements and fitness goals
• Receive motivational reminders

3. Eligibility

You must be 18 years of age or older to use Gainly. By using the app, you confirm that you meet this requirement. The app is designed for adult users engaged in personal fitness tracking.

4. Subscription Terms

4.1 Free Tier

The free tier includes a limited number of AI analyses as described within the app. Limits are subject to change with notice.

4.2 Pro Subscription

The Pro subscription provides expanded access to AI analyses and is available as a recurring subscription with a 7-day free trial.

• Trial period: 7 days free. If you do not cancel before the trial ends, your subscription will automatically renew at the applicable price.
• Billing: Subscriptions are billed through your Apple ID on a recurring basis (weekly, monthly, or annually, depending on the plan selected).
• Cancellation: You may cancel at any time through your Apple ID subscription settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for unused portions of a subscription period.
• Price changes: We reserve the right to change subscription prices. You will be notified in advance through the App Store.

All billing is managed by Apple. We do not process payments directly.

4.3 Refunds

Refund requests must be submitted to Apple directly via reportaproblem.apple.com. We do not issue refunds outside of Apple's standard refund policy.

5. Acceptable Use

You agree to use Gainly only for its intended purpose of personal fitness tracking. You must not:

• Use the app for any unlawful purpose
• Submit photos of minors for analysis
• Attempt to reverse-engineer, decompile, or tamper with the app
• Use the app in any way that could harm yourself or others
• Circumvent usage limits, subscription gates, or other access controls
• Submit photos that violate applicable laws or third-party rights

6. Health and Fitness Disclaimer

Gainly is not a medical application. The AI analysis provided is for informational and motivational purposes only and does not constitute medical advice, diagnosis, or treatment.

• Do not rely on Gainly's analysis as a substitute for advice from a qualified healthcare or fitness professional
• If you have any health conditions, consult a doctor before starting a new fitness program
• AI analysis scores and assessments are algorithmic estimates and may not reflect your actual health status
• We expressly disclaim any liability for health decisions made based on information provided by the app

7. Intellectual Property

All content within Gainly — including but not limited to the app design, graphics, text, AI prompts, and software code — is owned by Turlybek Dostan Turagazyuly and protected by applicable intellectual property laws.

You retain all rights to the photos and personal data you enter into the app. By submitting photos for AI analysis, you grant us a limited, temporary licence to process that data solely for the purpose of generating your analysis result.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• Gainly is provided "as is" without warranties of any kind, express or implied
• We do not guarantee that the app will be error-free, uninterrupted, or always available
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the app
• Our total liability to you for any claim shall not exceed the amount you paid for the app in the 12 months preceding the claim

9. Service Availability

We reserve the right to modify, suspend, or discontinue the app or any of its features at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.

10. Third-Party Services

Gainly uses the following third-party services, each governed by their own terms:

• Apple App Store — for distribution and payment processing
• Apple iCloud — for data synchronisation across devices
• Apple App Attest — for device integrity verification (App Check)
• Anthropic Claude API — for AI-powered photo analysis
• Google Firebase (Cloud Functions, Firestore) — secure proxy and usage-limit enforcement

We are not responsible for the practices of these third-party services.

11. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of material changes through an in-app notice or by updating the "Last Updated" date. Continued use of the app after changes are posted constitutes your acceptance.

12. Governing Law

These Terms shall be governed by and construed in accordance with generally accepted principles of international commercial law. Any disputes shall be resolved through good-faith negotiation between the parties.
